1. Purpose
These conditions govern the sale and delivery of original artworks by NicDA, sold directly from the artist’s studio and marketed through the website nicda.eu. By placing an order, the Client expressly accepts these Terms and Conditions.
The works are described in each product listing, indicating measurements and materials. Each artwork is printed on premium 500 g/m² vinyl canvas, providing high resolution, sharpness, vibrant colors, and a glossy finish. The final print size is 110 × 110 cm, with an additional 5 cm black border on each side for easy mounting on a frame.
The artwork is printed using industrial six-color UV technology on a Durst Rho P10 large-format printer, delivering high image definition, smooth color transitions, and durable outdoor performance.
The artwork is shipped unframed, carefully rolled and protected in a sturdy cardboard box. The canvas is designed to be framed on a stretcher bar no more than 3 cm deep, leaving the edges in black color for a finished look.
As a guarantee of authenticity, all artworks bear the sign “NicDA” printed on the front, below to the right. A digital Certificate of Authenticity is sent by email, signed by the artist with the buyer’s name and date, guaranteeing originality and exclusivity.
Please note: the artwork is not delivered with a frame. Photographs are for illustrative purposes only and may not be to scale, so please carefully check the actual dimensions provided in the artwork description. The colors you see on screen may vary slightly from the actual colors of the artwork.

2. Formation of Contract and Order Acceptance
1. The purchase is made through the website’s ordering process. The Seller’s acceptance of the order is confirmed when the Customer receives an order confirmation email containing the order number and a summary of the details. Until this email is received, no binding contract exists.
2. The Seller reserves the right to reject orders for legitimate reasons (out of stock, pricing errors, suspected fraud, etc.). In such cases, the Customer will be informed and, if applicable, any amounts already charged will be refunded.
3. Each artwork is a limited edition of 8 copies. Once this edition is sold out, no additional copies will be produced, guaranteeing exclusivity for collectors.

3. Prices and Payment
1. Sales prices appear on the website in euros (EUR) and include the legal VAT applicable in the European Union unless otherwise indicated.
2. Applicable shipping costs will be indicated at the time of payment and depend on the destination country, as indicated in the Shipping section.
3. Accepted payment methods: PayPal, Stripe (credit/debit card), and Google Pay. Bank transfers and cash on delivery are not accepted.
4. Payment will be made through the methods enabled in the integrated payment gateway. The Seller does not have access to or store the full card number (this data is managed by the payment provider). The Seller may temporarily suspend the payment service if suspicious activity is detected.

4. Delivery and Shipping
4.1 Shipping Countries
Austria, Belgium, Bulgaria, Canada, Croatia, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Poland, Portugal, Romania, San Marino, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom, United States.
4.2 Delivery Times
– Europe (European Union, United Kingdom, Switzerland): approximately 7 business days from order confirmation and receipt of payment.
– Canada and United States: approximately 14 business days from order confirmation and receipt of payment.
Delivery times are indicative and may be affected by customs procedures, courier services, or extraordinary circumstances.
4.3 Shipping Costs
– Austria, Belgium, Bulgaria, Croatia, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Luxembourg, Netherlands, Portugal, San Marino, Slovakia, Slovenia, Spain, Sweden, and the United Kingdom: FREE SHIPPING.
– Canada, Cyprus, Lithuania, Malta, Monaco, and Switzerland: Flat rate of €30.
– Norway, Poland, Romania, and the United States: Flat rate of €100.
Important: For shipments of 2 or more artworks, combined shipments may be made at the Seller’s discretion. The Seller will endeavor to combine shipments whenever possible but is not obligated to do so. Shipping costs include the cost of insurance covering the artwork in transit according to its declared value.
Legal Notice: The Client is responsible for any customs duties, import taxes, or local fees required in the destination country (especially for shipments outside the EU). These costs are not included in the purchase price or shipping.

5. Risk and Ownership
The risk of loss or damage to the goods passes when the carrier delivers the artwork to the Client. Ownership of the goods will pass to the Client once the Seller has collected the full price.

6. Returns and Right of Withdrawal
1. Once an order is placed and payment is confirmed, production begins immediately, as each artwork is printed on demand using premium materials. For this reason, the Seller is unable to accept cancellations, returns, or exchanges.
2. Every piece is carefully inspected before shipment to ensure it meets the Seller’s high-quality standards.
3. In the unlikely event that the artwork arrives damaged, the Client must contact the Seller immediately by email at info@nicda.eu, indicating the order number and attaching photographs of the damage and the packaging. If damage is noticed upon receiving the package, it is important to inform the carrier so they can record the issue. As the shipment is insured, the Seller will arrange a reprint as soon as possible.
Exception: If the legislation applicable in the Client’s country establishes different mandatory conditions, the corresponding regulations will apply.

7. Warranty and Conformity
1. The legal warranty established by European Union regulations applies: 2 years for tangible goods. During this period, the Client may request repair, replacement, or refund as required by law.
2. Claims for lack of conformity must be communicated to info@nicda.eu, indicating the order number, a description of the defect, and photographs, if applicable.

8. Intellectual Property
The Artist retains all intellectual property rights over the artwork, images, and text on the website. Except with express written authorization, the Client may not reproduce, transform, distribute, or publicly communicate the artwork or images published on the website.

9. Limitation of Liability
To the maximum extent permitted by law, the Seller’s liability for damages arising from the use of the website or the acquisition of the works is limited to the price paid for the work in question. The Seller shall not be liable for indirect damages, loss of profits, or loss of goodwill caused to the Client.

10. Data Protection
The personal data provided by the Client will be processed in accordance with the website’s Privacy Policy and applicable regulations (GDPR and Spanish regulations). The processing is for the purposes of order management, billing, delivery, and customer service. 11. Communications
Communications will be sent to the email address provided by the Client in the order. The Client agrees to receive communications related to their order through this means.

12. Force Majeure
The Seller shall not be liable for failure to perform its obligations when such failure is caused by circumstances beyond its reasonable control (strikes, natural disasters, pandemics, transportation problems, acts of authority, etc.).

13. Modification of Conditions
The Seller reserves the right to modify these Terms and Conditions. The conditions applicable to each order will be those in force at the time of its formalization.

14. Partial Invalidity and Severability
If any provision of these Terms is declared invalid or unenforceable, such invalidity shall not affect the validity of the remaining clauses, which shall remain in force.

15. Applicable Law and Jurisdiction
These conditions are governed by Spanish law. For the resolution of any conflict or controversy arising in relation to these conditions, the parties submit to the Courts and Tribunals of Alicante (Spain), expressly waiving any other jurisdiction to which they may be entitled.
